Welcome to the Photo Centre page of Costco Wholesale UK Ltd with its registered address at  213 Hartspring Lane, Uk Home Office, Watford, Hertfordshire, WD25 8JS and company number 02635489 (“Costco”). You may order prints and other photo products from the Costco Photo Centre by uploading digital images to your Costco Photo Centre Account for you to collect at a Costco warehouse.

Please Note: Costco online only subscription is not valid for Costco’s online Photo Centre. You must have a trade or individual membership and set up your Costco Photo Centre Account. 

These Terms and Conditions of Service (“Terms”) govern Costco’s online Photo Centre service (“Service”). Your use of the Service constitutes your agreement to be bound by these Terms. Please read these Terms carefully before you use our Service. We may change or update these terms from time to time so please check this page regularly to make sure you have reviewed the most up to date Terms.

These Terms do not apply if you have placed your order with one of our associated providers (CatchinColour or NeedaBanner). Please review their terms and conditions.

If you would like to contact us for any reason regarding Costco’s Photo Centre Services or these Terms, please feel free to contact us at: centralphoto@costco.co.uk.

If we need to contact you for any reason we will do so by phone, email or by writing to you at the postal address that you provided to us in setting up your Costco Photo Centre Account.

1. Access to the Service

The Service is available only to Costco members for fulfilment and delivery in the UK. The Service allows eligible Costco members to upload digital images for print out, payment online and pickup at the designated Costco warehouse or payment online for home delivery.

2. Your Order

Orders will be confirmed by Costco via email. When Costco confirms your order by email, a binding contract will come into force between you and Costco for the purchase of your order and our supply of the Service to you.

If we are unable to accept your order, we will inform you of this and will not charge you for the order.

During the order process we will let you know when we will be able to deliver your order to you or when it will be ready for collection from the designated Costco warehouse. If you have asked to collect the products from a designated warehouse, you can collect them from the warehouse during its opening hours.

3. Pricing and Payment

The price of the product (which includes VAT) is indicated on the order page and will depend on which product you have selected. We take reasonable care to ensure that the price of the product advised to you is correct and will let you know if we discover an obvious pricing error.

When you are collecting your order from a designated Costco warehouse, you agree to pay for your order online prior to collection.

4. Returns and Your Rights

We may issue a refund if ordered products are faulty or if your products are not in accordance with your order or expectations.

For a refund, please email centralphoto@costco.co.uk with your request within 90 days of receiving your order. Please include your reason for the refund, along with your order number and membership number to help us assist with your query more quickly.

Items purchased from costcophoto.co.uk will be refunded in full - including delivery costs and will be credited to the card used to place your order.

If you have ordered from our associated provider Needabanner.co.uk, please review their terms and conditions for their own policies on refunds.

5. Your Content and Use of the Services

Costco does not control the content of your images and has no obligation to monitor or review such content for any purpose.

You are solely responsible for all content and material (“Your Content”) you provide for the Service and you warrant that you own Your Content or have obtained all relevant permissions from the owners of any intellectual property right owners (such as copyright or trade mark owners), who own such rights in Your Content, to order your selected product.

By uploading Your Content to your Costco Photo Centre Account, you grant to Costco and its affiliates a perpetual, irrevocable licence to use, develop, manufacture, copy and reproduce Your Content in order for Costco to provide its Services to you and to improve Costco’s Services (for example, when you raise a query with us relating to your order).

6. Your Responsibilities

You must have the legal right to copy every image that you order and you must ensure that you have all relevant permissions you need from anyone else who may have intellectual property rights in your images (for example, they may have copyright ownership or trade mark ownership in the contents of your images). Costco may ask you to provide confirmation that you have permission from the intellectual property right holder, if you are not the owner of the intellectual property rights in Your Content.

Photographs obtained from websites or print publications may be protected by copyright and should not be sent to Costco.

You are responsible for making sure that other individuals in your photographs are happy for you to order products that contain their image.

You agree NOT to use the Service:

  • for any illegal, unlawful or improper purpose;
  • to upload any material that is obscene, indecent, offensive, blasphemous, pornographic, illegal, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libellous, vulgar, or that is otherwise objectionable;
  • to upload any material that you do not have a right to transmit under any contractual or fiduciary relationship or which infringes any copyright, trade mark, patent or other intellectual property right or any moral right of any other party including, but not limited to, Costco;
  • to harm minors in any way, including, but not limited to, providing content that is indecent, violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct;
  • to upload any material which is likely to cause harm to Costco’s or anyone else’s computer system, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorised access to the Service which may cause any defect, error, malfunction or corruption to the Service;
  • to interfere with or disrupt this Service or servers or networks connected to this Service, or to disobey any requirements, procedures, policies or regulations of networks connected to this Service; or
  • to provide any information to Costco that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose.
7. Changes to and Suspension of Service

Costco may at any time without notice:

  • change or suspend any part of the Service (for example, to deal with technical problems); and/or
  • refuse to fulfil any order and delete any images you have sent to the Service and your Costco Photo Centre Account if, in Costco’s sole and reasonable discretion, you fail to comply with any of these Terms or if a competent regulatory authority requires Costco to do so; and/or
  • delete your digital images following printing. Costco is not obligated to store your digital images for you.

Notwithstanding these Terms, Costco reserves the right, without notice and in its sole and reasonable discretion, to terminate your licence to use this website, and to block or prevent future access to and use of this website if you breach any of these Terms or applicable law.

8. Privacy, Security and Your Account

Costco is committed to safeguarding your privacy. Click here to view Costco’s Privacy Statement for more information on how we use, collect, store and disclose personal information to provide the Services to you.

You are responsible for maintaining the confidentiality of the password to your Costco Photo Centre Account. If you use a shared computer, remember to sign-out once you finish submitting your orders to the Costco Photo Centre.

In the event that the confidentiality of your account or password is compromised in any manner, you must immediately notify our Customer Care Centre on our free phone number 0800 0324 324.

We reserve the right to take any and all action as necessary or reasonable to maintain the security of the Costco Photo Centre website and your Costco Photo Centre Account, including but without limitation to: terminating your Account, changing your password or requesting information to authorise or cancel transactions on your Account.

While we take reasonable steps to protect your Account and our website, we cannot protect your information outside of the website. For example, if we communicate with you electronically but outside of the website (for example, by email), you acknowledge that the communication may not be transmitted and/or stored securely, and may be viewed by others. You acknowledge that by requesting information by e-mail, we may transmit it to you and store it in an unencrypted form. Similarly e-mails you send to us may also be unencrypted, and thus may be viewed by others.

We may rely on the authority of anyone accessing your Costco Photo Centre Account or using your password. You accept responsibility for their activities. In no event will Costco be liable to you for any liabilities or damages resulting from or arising out of any unauthorised access to your Costco Photo Centre Account due to your actions.

9. Costco’s Liability

Costco will conduct the Service with reasonable skill and care, and will use its reasonable endeavours to ensure that the Service is available at all times.

The service is provided by Costco on an “As Is” and “As Available” basis, and Costco makes no representation or warranty that the Service will be accessible, usable or error free.

You are advised to keep backup copies of all material downloaded or uploaded through the Service and/or emailed to Costco. Costco will not be responsible for keeping backups or for the loss of, deletion or corruption of, or damage to any content, images or any other material.

Costco is not responsible for any delays to your order that are caused by events that are outside of Costco’s control. If your order is delayed by such an event, then Costco will contact you to let you know and we will use reasonable efforts to reduce the impact of the delay on your order. Where we do so, we will not be liable to you for any inconvenience or loss caused by delays that are outside of Costco’s control. However, if there is a risk of that your order will be substantially delayed then you may contact us using the information in Section 12 of these Terms to end the contract in place between us under these Terms and receive a refund for any products you have paid for but have not received.

Costco does not exclude or limit in any way its liability to you where it would be unlawful to do so. Nothing in these Terms shall apply to limit or restrict Costco’s liability in respect of fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products or for death or personal injury arising from Costco’s negligence in relation to these Terms and the Services provided by Costco under them. Costco will only be liable for losses that are foreseeable (i.e. you and Costco thought such a loss might occur when we entered these Terms).

If you are not a consumer or your order is for any commercial or business purpose, you agree that Costco shall not be liable to you in contract, tort, negligence or otherwise for any i) loss of revenue, ii) loss of business, iii) loss of contracts or opportunity, iv) loss of profit, v) loss of data, vi) loss of goodwill or reputation or vii) for any indirect, consequential or special loss or damage resulting from the use of the Service or otherwise in connection with these Terms.

10. Trademarks

All trademarks, service marks, names, and other intellectual property used in reference to the Service that identify Costco or third parties and their products or services belong to Costco and/or the relevant third parties. Neither the offer nor provision of the Service shall be deemed a grant to any person of any licence or right.

11. Copyright

Costco and/or the relevant third parties own all copyright (including copyright in software) and database rights in the Service, its contents and delivery, unless stated otherwise. Publishing, distributing, reverse engineering, decompiling, extracting, modifying, re-utilising and reproducing any such content in any form, whether in hard or soft copy form, is strictly prohibited.

12. Queries and Complaints

We pride ourselves in providing the best service and products to members, if you are unhappy with your order, please email centralphoto@costco.co.uk to find a solution or speak to a member of our staff in one of our warehouses. Please include your order number and membership number to help us assist with your query more quickly.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English Courts.

Please note that if disputes arise between us, these may be submitted for online resolution to the European Commission Online Dispute Resolution platform here.

14. Entire Agreement

These Terms incorporate by reference the rules that govern your Costco membership. These Terms constitute the entire agreement between Costco and you with respect to your use of the Service. Costco’s failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court should find that one or more right or provision contained in these Terms is invalid, the remainder of the Terms shall be enforceable.

15. These Terms apply to You and Costco

Nothing in these Terms shall permit any third party any benefit or right to enforce these Terms that are in place between you and Costco as the Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms.
